Ocean Springs Police Department said in a Facebook post that electric bicycles are subject to the same traffic duties and local regulations as traditional bicycles and urged residents to follow safety rules to protect riders and pedestrians.
The post advised riders to remain properly seated and maintain control, and it strongly discouraged dangerous stunts such as wheelies or any riding that prevents both wheels from remaining on the roadway. It said bicycles and e-bikes may not carry more people than the vehicle was designed to accommodate and that passengers must have an appropriate, firmly attached seat.
Other reminders included riding no more than two abreast on roadways unless on a path or lane designated exclusively for bicycles, never clinging to or being towed by another vehicle, keeping sidewalks and pedestrian areas clear, and avoiding racing on public roads. Riders were also urged to keep both hands available for control and not carry items that prevent proper handling.
The department outlined state law guidance, saying Mississippi generally treats an electric bicycle as a bicycle rather than a motor vehicle, dirt bike or ATV, and that e-bikes may be operated where bicycles are permitted subject to state and local restrictions. The post noted additional requirements for Class 3 e-bikes: no person under 16 may operate one, Class 3 e-bikes must have a working speedometer, required manufacturer labels identifying classification, assisted speed and motor wattage must not be altered or removed after modification, and the electric motor must disengage when the rider stops pedaling or applies the brakes.
The department warned that vehicles that do not meet Mississippi’s legal definition of an electric bicycle may be subject to different licensing, equipment and operating requirements and asked residents to ride responsibly and remain alert. We will provide more information as it becomes available.
