Court tosses $50,000 judgment against Jackson salon
JACKSON, Mississippi — The Mississippi Court of Appeals on Monday overturned a $50,000 judgment against a Jackson hair salon in a dispute over the use of a model’s images in advertising.
Ada Green sued salon owner Latrice Rogers in 2022, saying Rogers placed photos of Green on billboards, flyers and vending machines to advertise the hair extension business Goddess of Great Lengths without consent or payment. A Hinds County jury last August awarded Green $150,000, which Judge Adrienne Wooten later reduced to $50,000.
The appeals court reversed the judgment, saying Green’s own conduct undercut her testimony. The court cited Green’s social media posts celebrating seeing herself on billboards and describing herself as a “brand ambassador” for the salon — a role she denied in court — and noted she never asked Rogers to remove the photos during the roughly six years they were used.
Rogers testified that Green agreed to the photo shoots and selected which pictures appeared on marketing materials, and two other witnesses supported that account. The appeals court said Green failed to prove Rogers used her image without consent and dismissed the case.
One appeals court judge dissented but did not explain the reason. This ruling highlights how consent and documentation shape image-rights disputes under state law.
