Starkville clarifies where trespass towing applies

Starkville’s municipal code says trespass towing rules apply to nonconsensual tows from private property within city limits, including private parking lots, apartment complexes and business parking areas, according to ordinance 11.17 on nonconsensual (trespass) towing.

The ordinance distinguishes those tows from police-directed removals and tows requested by vehicle owners, which are subject to different procedures and protections, the code says.

Trespass towing generally allows private property owners or managers to have vehicles removed when they are parked without permission. Local ordinances typically set requirements for signage, notification and release procedures to protect vehicle owners and ensure tow operators follow the law. Starkville officials have posted the guidance as part of an ongoing series explaining what residents should know about trespass towing.

The guidance matters to drivers, property managers and tenants because it affects when a vehicle can be removed and how owners regain possession. Readers seeking the full ordinance can consult Starkville’s municipal code. We will provide more information as it becomes available.
